DIGITS LLC can assist inside and outside counsel in all phases of litigation, from pre-filing preparation and case assessment, Electronic Discovery, responding to and preparing computer related interrogatories, and working with your client’s IT staff and technology vendors to meet the new Federal rules, or reporting and regulatory requirements.

DIGITS LLC HR Escrow Program:

Protect the electronic data needed in employee related litigation by forensically imaging the evidence stored in employees’ computers and other digital devices before litigation arises. DIGITS LLC will maintain the images through the notice of claim period or until an action is commenced. If no action is brought, DIGITS LLC will certify the destruction of the images in accordance with Department of Defense specifications. A forensic grade image of all devices, such as desktops, laptops, blackberry’s and other personal computing devices are the only way to successfully recover valuable deleted information as well as user habits and system usage.

Once an action is brought by the employee or if the employer wants to conduct a due diligence investigation into the employee’s usage habits before termination, DIGITS LLC then quickly and intelligently processes the forensic escrow images for key data. Leveraging over 60 years of law enforcement and computer forensic experience, the most critical and relevant electronic forensic data is immediately extracted and provided to the client for their review by Counsel and HR decision makers to help defend costly employee matters.

Current Modus Operandi:

1. Company issues computer, a laptop and a Blackberry to employee

2. Employee leaves company

3. Devices are repossessed by company

4. Devices are assigned to new employee

5. Data in previous employee’s devices is LOST FOREVER

6. Departing employee files a complaint

7. Company is unable to present evidence to defend itself or settle the case

8. Cost to company: Attorneys and litigation fees, penalties and damages to pay

DIGITS LLC’s Strategy:

1. Company suspects a labor law complaint may be filed by employee.

2. DIGITS LLC makes a forensic grade image of the employee’s digital devices.

3. Company has forensic evidence preserved and escrowed for later retrieval of valuable digital forensic evidence.
